My friend got a dui in Minnesota he blew over at the scene ..arrested then he was asked to blow again at the station he was confused asked about a lawer...ultimately did not blow so his offense was enhanced to a gross misdemeanor ...now had he spoken to an attorney 1), if you are under the limitrd blow...2) if you are over the limit blow......otherwise the offense automatically is enhanced and you lose your license for a year....
HE HAD NO IDEA THAT HE WAS ENHANCING HIS CRIME BY NOT BLOWING..his confusion was evident on the video....MENS REA?

We are facing this insanity right now because bureaucrats were given the power to write laws and regulations. We must put lawmaking a sole power of the legislative branch one again.

Ignorance of the law is no excuse. That is the foundation of our legal system. If you don't know what the speed limit is where you are and you exceed it, you've still broken the law. Intent should only be used to determine the severity of punishment and not whether a punishment should be applied at all.

@QuentinsCornerNicely done. The inequality of application of Mens Rea is shocking. Seems cops don't have to know the law, and are free to violate it under sovereign immunity, but the citizens are assumed to carry an attorney at all times.
