What is Mens Rea? [No. 86]
Video Overview & Insights
Criminal law is primarily concerned with two elements - the outward act and the inward state of mind. Professor Joshua Kleinfeld explains mens rea which is the standard used to determine the intention, or lack thereof, in a crime. Professor Kleinfeld discusses different examples where the same circumstances might or might not result in a crime, depending on the state of mind of the person involved.
Unfortunately this is completely and totally untrue.
The courts regularily punish minds with no guilt or shame al all and do not require any evidence at all supporting that a crime was commited.
Ask Ramsey and Anoka Counties in Minnesota. No evidence. No guilty mind. They don't care.
Joshua Kleinfeld is Professor of Law at Northwestern University Pritzker School of Law. He teaches and writes in three areas: legal and political philosophy; legislation and statutory interpretation; and criminal law and procedure.
As always, the Federalist Society takes no position on particular legal or public policy issues; all expressions of opinion are those of the speaker.
Thank you. I have an order of protection against me. I walked by the protected person’s home, she called the police on me. A patrolman came to my home and interviewed me and told me I didn’t break the order of protection., no arrest.
12 days later I walked in the same area with no criminal intent, I was under the impression that area was ok by the patrolman cleared by the police officer . She sent someone to harass me I called the cops on the third party. The protected person called the cops on me.
I thought I was being asked questions about my call. But I later found out the officer was interrogating me from the protected persons call. They didn’t investigate my call to The police. Long story short I got arrested. Not I have a pre trial hearing. This info will benefit me. Also I was being secretly interrogated , I felt I wasn’t about to leave and no Miranda rushes was giving.

@Mikitadesse837That explains a lot to situations when a defendant is 'playing dumb' when the obviously did have mindful intention.

@bellekay5399Best explanation ever,, thanks
@ndinawerebeccan2083I don't understand.
I got a case with University in Montreal where I was charged with criminal harassment basically. Said it was moral harassment (workplace related so CNESST) as I tried to get my foreign work experience recognised and my foreign credits transferred but was met with rejection, was banned from campus, met up to my constitutional rights exam, was eventually arrested and went to preventive detention in RDP prison and then my legal aid lawyer wanted to get an insanity defence so I saw a male shrink who said I was criminally responsible as I had been victim of verbal abuse, moral harassment and stalking while in Europe by a girl (France and Norway). Didn't even know what a restraining order was so I never got one. Was evaluated again against the DPCP's advice (ministère public) but the judge gave my lawyer a second chance. Was perceived as not criminally responsible by the shrink with a psychosis and had go be treated with Abilify against my will for 3 years with annual meetings with the RBMD of Québec.
I recently remembered I had committed a credit fraud during the semester I was studying for the law certificate at university, or 2 online transactions (admission into a business creation certificate and payment for blog called suicidal thoughts). Thus proving there was mens rea and actus reus during the period that was deemed "psychotic" as I obviously knew it was wrong to use that credit card but I didn't care.
So what now?
I’m currently studying criminal justice and I’ve been so stuck with understanding mens rea and I’ve finally found this video that helps me understand it so much better than the books. THANKSSSSS😊
