Hypothetically, could shooting someone in the leg be used as evidence that the shooter was trying not to kill their attacker?

I get that it's not a good strategy as far as lethality and incapacitation are actually concerned, and that it's not going to matter to a prosecutor, if the attacker happens to die, as far as charges are concerned.

Just in terms of the legal defense though, could "my client attempted to incapacitate the attacker while minimizing the likelihood of death" be useful in some way?

I mean he wasnt the aggressor .... he didnt produce the gun until he was being charged at with a weapon.... he gave clear audible warnings to stop advancing on him.... he even backed up trying to create distance but the man kept coming. He also instead of aiming for the torso (& up where a miss could have done more damage elsewhere) fired low at the leg.

He did nothing wrong. Heck the accident wasnt even his fault. Wonder if there was any info on if the man who died had a warrant or if anything illegal was found in his vehicle or maybe if he was DUI. To flip out that much about the cops being called for a wreck YOU caused seems a bit much. My guess is he had warrants/had something illegal on him/or was intoxicated.

Dont get me wrong im not saying its not possible it was something else like the guy just has anger management issues or just had an insanely horrible day with tons of other built up stress & just popped ..... just saying i think the chances are higher its one of the other 3 things i listed before.

Perhaps the guy in blue was concerned about the bullet hitting innocent people if he misses or if the bullet exits the perp with sufficient velocity. There was such a busy area, the ground seems like the best backstop.

I haven't heard you guys talk about the guy in red's state of mind. You mentioned do we recognize the shovel handle as a deadly threat? You said, yes. That means the defender sees the state of mind of the guy in red as a mental approach to causing death or great bodily harm. Just because Red doesn't have the shovel handle anymore, I think you can make a great argument that Red is still posing a deadly threat if he gets a hold of an object of opportunity or the gun as a deadly threat. You did touch on that at the end of the video, but only briefly. I htink the state of mind for Red is the key to the defense on this.

Unnarmed, armed, doesn't matter at all when someone's getting closer to you despite being warned not to (not sure the guy in blue shirt told the one in red to back off, but common sense implies so).
The man in blue was only protecting himself from possible harm, even if the other guy dropped his "weapon" he was indeed still a threat because he didn't back off imediately, so he got only what he asked for, unlucky that it hit a vital spot but that's always a possibility.
I'm not sure how law will handle this case, but the man in blue shouldn't be in any trouble at all for defending himself, but as we all know, society nowadays does not care about right or wrong, just care about how media will adress it, and given what i've seen lately it will appear on the news as "Gun owner shoots unnarmed man fatally"... That's the world we live in :/

Id love if John or any expert would comment on this angle... He drew his gun initially justifiably because the weapon constituted deadly threat, but then although the weapon was tossed, a crazed man wants to physically attack him and could easily get the gun - this is almost more scary than the shovel handle in my view. ahhh I typed too soon and just heard John recognise this very thing.

This is what Bowling for Columbine said perfectly. The constant push for fear of death, has warped American's minds that everything is a deadly threat. In any civilized society, you'd get charged and convicted for murder. But here? Look at all these commenters just frothing around the month for the chance to justify a murder, that they would have loved to be a part of so they would have the chance of being the "hero" who killed a person to defend themselves.

The guy in the red shirt was heading towards the guy in the blue shirt with a shovel handle, and it looked like he wasn't just planning on talking. His intentions seemed pretty threatening. The guy in the blue shirt didn't want to kill him, which is why he shot him in the leg instead of the body.

If I’ve drawn my firearm because you have a weapon, and you then proceed to throw away that weapon and STILL come after me, I’m going to assume you’ve just eyed your next weapon that you’re going to attempt to take from me and use on me… This is definitely a clean shoot.

Looks like self defense to me. Shooter did not initiate, and backed off a reasonable distance. He was already threatened with one weapon. I would have shot him.

This reminds me of black lady in parking lot . You are signing your own death certificate when you see someone aiming down sight towards you and continue to advance towards you. This was self defense he shot once aimed at leg. He didn't want to kill him. But why wasn't it looked at as aggressive here for driver the way it was for black woman who met immediate aggression from white male in last video? Y'all decide but shout out to ASP for great self defense videos. I'd like to see better takes when it comes to black women defending themselves against white men

He was “armed” with a shovel which can cause serious bodily injury. Therefore the shooting was justified. The fact that he shot him in the leg means he had no intent to kill him. Since when does being “unarmed” only applies to firearms?

[7:48] Yes, it is reasonable to say that the man should not have been standing in the crook of his car door, because he's somewhat trapped there. BUT ON THE OTHER HAND, 'HIS' pickup truck was not immobilized in that accident, and therefore IF the other driver became aggressive A) retreating into the safety of a metal cage (the inside of the truck) offers some protection, and B) the pickup truck driver, by staying close to the car door, maintained the option of being able to *get in the truck and drive away if for example the other driver had drawn a gun.

The public here in Costa Rica are beyond pissed that the self defender is facing heat because Costa Rican laws are practically made to punish the defender more than the attacker. The courts are seeing if they review the original dicision that this was self defense. People here are mad because we're seeing more violence and the good guys are facing trouble for defending ourselves.

I'd say in most States this is a justified self defense shooting.

I got rear ended by someone who didn't have insurance once and they go on the offensive to try to intimidate you to let it go.
