If I ever had to go court and somehow got this man as my lawyer, I would feel safe. I mean that with every fiber of my being.

i dont get why mike isnt just a legal assistant(paralegal). does drafts but not sign, factfinding, giving advice on law application etc.
mike doesnt need to be a lawyer to be basicly a living instant google for anything related to the law.

Also you are correct. Once Indicted by a grand jury there is not a time frame for discovery UNLESS someone is demanding a fast and speedy trial. Which in my state is 90 days. At said trial if there is no Discovery then there could be a problem.

Objection! Mike's problem was never a problem. HE LIED. They can't be liable for not investing every potential employees.

I watched the first episode of Suits when it originally premiered on the USA Network, but I found the entire premise of the show to be so ridiculous that I never watched another episode. Knowingly hiring someone who was not only unlicensed but who never even went to law school as an associate at your law firm would be an insane thing to do. The moment Mike signed a pleading, made a court appearance, or was introduced to a client as a lawyer, he would be committing a crime. It is actually illegal to practice law without a license. As for Harvey, allowing Mike to work as a lawyer in your firm despite knowing he wasn't licensed would be a violation of the Rules of Professional Conduct that would get him disbarred if and when it was discovered. Why would anyone run that kind of risk? What was in it for Harvey?



The thing is, there was a perfectly legal way to employ Mike to do most of the work of an associate attorney. Basically, paralegals are allowed to do legal research and draft motions and briefs. They would just have to be signed by a licensed attorney before they were filed with a court. At the same time, Mike could go to law school at night. He could complete a law degree that way, or after the completion of the equivalent of the first year of law school, NY State allows for a Law Office Study apprenticeship under the tutelage of a licensed attorney. I believe Kim Kardashian did some kind of Law Office Study program in lieu of law school. Unfortunately, for her, she failed the California Bar Exam. I believe that bar exam has the highest failure rate of any bar exam.



Of course, most legal shows bear very little resemblance to the actual practice of law. Some are better than others. I remember watching Murder One during my first year of law school in 1995. Unlike most shows that resolve cases in a single episode, that show followed a single case for the entire season. I was watching it with some other law students when an associate handed some case research to Daniel Benzali's character. He asked them, “Did you Shepardize these cases?” and all 4 of us were leaning forward doing the Leonardo DiCaprio meme 25 years before Once Upon A Time IN Hollywood was released. We had just learned about Shepardizing that week. For anyone who hasn't gone to law school, Shepard's Citations is a way to determine if a case is still good law or if that case has been overturned by a more recent case.

Lmao I have not known a lawyer that hasn’t lied. Won a suit in federal court in summary judgement that hired an expert witness that bought software to show copyright violations from my expert witness. Then the lawyers lied and pushed it forward cost millions over lies . Yes we won but a major law firm lied. Did anything happen to them? No

Watching suits right now, just finished Season 7 when Mike and Rachel (and Jessica) all leave. Assuming the last two seasons will be like The Office where its good, but not the same.

I mean this basis for the whole show but they could’ve just made Mike Ross paralegal would’ve been the same thing

I thought he is suppose to be a real lawyer who can say for sure if it is a crime? LOL

some legal and medical tv shows really make everything very silly without consulting real professionals (or only asking those who fantasise about this sort of thing) and Suite is one such example.

only to induce a CEO to close a deal without destroying someone else's reputation and without excluding that other person from the deal. Harvey was trying to fullfil the companys deal as it was set and trying to avoid to have to deal with personal grudges by the CEO.... Yes by lying. Still. Not every lie is fraud.

SO

The defrauded entity would have been the company not the CEO himself.

BUT

there is no, none economic loss by the company. And Harvey is also not making them occur one or trying to.

He is literally trying to avoid the CEO to act in bad faith. He tried to prevent the CEO to let personal feelings get in the way of the COMPANY s deal.

THEREFORE.

no fraud. He is actually looking out for the company s interst (which is his job) and by (amoral) means trying to keep the CEO from getting personal feelings to get in the way of the companys interest
