The real-life joker guy is probably VERY happy that he is referenced in the GTA VI trailer. He will probably gain financially from it even if he loses his lawsuit.

Regarding that there are crazy things happen in Florida (or in this case, Leonida in the HD Universe), I think it's a perfect time for Rockstar devs to pull out the Florida Man jokes from their pockets.

The Miami Joker doesn't have a case. This is something that has been actually litigated before. legally distinct parody. Lindsay Lohan tried to sue Rockstar over a character based on her in GTA V. While the inspiration is clear, it's also a parody of the Jared Leto Joker (with the forehead tattoo), and again, it all falls under parody.

There's even caselaw about copyright of tattoos in video games, and while a person who has the tattoos has image rights, the copyright for the artwork in tattoos actually belongs to the person who designed the tattoo, which, in cases like with CM Punk's Pepsi logo tattoo, goes ot Pepsi, which is why he doesn't have that tattoo in the WWE video games. This is not really related to the Joker thing, more just extra stuff I just happen to know because this is a special interest topic for me.

Florida has since implemented Constitutional Carry, so The Miami Joker would likely have only caught a charge menacing with a deadly weapon or a similar charge if he did his deed a year or two later. Also interesting fact about gang databases. If the detective in the case were doing his job now instead of 2008 he would not have access to the databases as a few years they deleted it because they felt it enabled "unfair" profiling of gang members. Laws change but the silly stories remain eternal.

Funnily enough, long before there were any leaks suggesting the setting would be Florida, there was a now famous clip of "Man on hood of truck" recorded while that truck was casually driving down a Florida highway. And I thought and commented: "Looks like the next GTA will be set in Florida!"

Lo and behold, this is the next setting. Thus, in keeping with capturing all the wackiness of Florida, I really hope the game will feature a similar random encounter where you can spot a man on the hood of a truck in reference to the real life event.
