CIRCUMSTANTIAL PROOF: The Case Against Nancy Brophy
Video Overview & Insights
Nancy Brophy was convicted of murdering her husband with no eyewitness, no DNA, and no recovered murder weapon (...sort of).
Long time no see! Appreciate everyone’s patience - I picked Nancy as a case I figured would be quick work, but it turned out getting from A to Z was a lot more convoluted than I’d anticipated! Main thing is it came out well in the end, imo, but that will be for you to decide.
Hope everyone has been having as good of a 2026 as current events can allow :)

This deep dive examines how circumstantial evidence — peripheral security footage, purchase history, financial records, and more — proved strong enough for a conviction.
We break down the timeline, Nancy’s testimony, and whether “circumstantial” really means “weak.”
You’re statement around the 1:31:00 mark is so spot on. Listening to her testify the entire time up to that point all I could think about was how she was really good at talking but not good at saying anything that made any sense. I’m almost tempted to believe she did kill him in a fugue state 😂

Nancy's full testimony for those interested in checking it out:

You should do a video on Dan Markel's murder. May have to make it a series tho with how many people are getting convicted as co-conspirators

Please Matt, never ever change to using an AI voice. I have a condition called misophonia. There are certain voices that I cannot tolerate. Not yours! I love your voice. It is so pleasing to listen to. Keep up the good work Matt!
More User Perspectives
Ok, as an actual IRL Phaedra, I am personally offended by her use of my name in one of her hack stories.
@plushultra1I just about lost it when the dispatcher was consoling the woman saying “I’m so sorry”.
@laurenmakridis9570I wonder what Dan saw in her? She comes across so impressed with herself which is a very annoying quality.
@michaelrecycle9838Yeah, I never made it all the way through watching the trial. The testimony just went all over the place.
@othername1000… that comment she spews “ they all had that SAD SACK look on their faces …”
Oh Lordy how I TRY … I TRY ! To cobble together /an excuse like “ that’s just The Broph’s Texas “downhome “ frontier -type VERBACULAR ….”
It does not STICK …it does not pass
THE SNIFF TEST
Also the The Broph describes era’s in the PRESENT TENSE , ( like Dan just LOVING COOKING LIKE A GOD DAM SLAVE during the holidays ) always , always , ALWAYS MAKES ME WANT TO PANIC .
Okay the edit at 33:08 made me giggle lmao
@lucidreamer6522We need more orchard
@jere9mazI’m new here, and in fact I haven’t yet watched this video properly or any video from this channel, but I like many others was a huge fan of JCS before the recent downfall and like many others have been struggling to find a channel that can replace it. However after trying many different avenues to try and find a replacement that is actually enjoyable, it seems pretty consistent that the people of JCS have moved here, and deem this channel as the place to go for our criminal minds videos. I’ve skimmed through this video and can already say, I see why. I look forward to watching through all your content, and hope you enjoy making these videos as much as I will enjoy watching them.
@KweeephAlso, if Nancy just told the truth about driving around in the first place, she may have gotten away with it.
@natecooper11711:20:38
Nancy: "Talking about Dan, period, makes me emotional."
*begins a series of unforced errors by the second"
clarinda perez's testimony broke my heart. my dad did CPR on my mom for over an hour straight before she died. i saw what that did to him. obviously this woman is absolutely evil for killing her husband in the first place, but shes equally evil for what she put that poor young woman through. i hope clarinda is able to find some sort of healing and support. i hope that she knows she did everything she could have and in my eyes she is genuinely a hero for trying to help him even if he was already gone. that takes some serious guts and a very big and brave heart to pull off.
@fightingforsunrise“The most important circumstance of all: love.”
@LJSpragueHer testimony and her gross lip smacking makes me want them to give her additional time
@Verbl.1The most disgusting part of this situation (aside from the literal murder) is when she insults and discounts the grief of the woman who tried to save Dan. Like, the poor woman just shows up to a cooking class on a normal day, does CPR for as long as she could and ends up watching someone die. Then his wife who should love him more than anyone says her grief wasn't that deep or serious. It's gross!! I hope that woman has found some peace in all of this.
@laurafobar-- circumstantial as an synonymous with weak, or at least presumably weak-EUGH
@flibbertigibbet-at-armsThe opening narration about circumstantial evidence was my first, and is still my favorite, part of a MOCS video. Because it exposed a common misconception propagated by movies that I was harboring,
@dirkbastardreliefHOW TF DID I MISS THIS NOTIFICATION 2 MO AGO?!
@Groccolithis is one case that tears at me everytime i see it, such a great man lost for so little reason at all
@notfreeman1776I FINALLY FIGURED IT OUT!!! Your voice! I've heard this voice. The tone, the cadence, the accent, the rhythm.. you're an old-timey Disney narrator! Peter pan, the jungle book, something like that.. I know someone knows what I'm talking about.. lol. I just re-watched The West Memphis Three video again, and in the beginning, that's all I can think about. I feel like I'm sitting cross-legged, 3 inches away from the tv, when I'm 7 years old, watching a Disney movie with my parents yelling at me to scoot back before I go blind. (I do have terrible eyesight now, like 20/200.. I can't see my hand in front of my face. I'm not saying they're related or anything but.. better to be safe than sorry, kids) .. except the West Memphis Three was the worst Disney movie ever made.. up until the 2010s or so. Still better than anything they're making these days though. 🫣
@SweetTexasTea86233:03 This segment was so absurd and the covers with titles so kitsch that I thought you were afraid to get copyright struck for including the actual titles and covers so you made funny goofy parodies of them.
I looked her actual books up, and couldn't believe these were real. I had to take a break from watching real quick to process that information
I discovered your channel long ago and I have a folder I put my favorite links in. Food For Pigs Is Not A Person video jolted me and I never forgot it. All your videos are great but I have to wait too damn long for you to release them. So, do what you gotta do and pump out three this month so I don't go into withdrawals! Jokes aside, great job, now go get it done!
@Reality4u2I wrote her a letter, I hope she got it, I remember it wasn't easy finding her. I spoke of great foods, weather and what a cold evil person she is. This woman is among the worse I've ever seen. He did everything while she sat on her butt and did nothing.
@Reality4u2guilty people often come with totally irrelevant information, whilst the innocent are very short in the answers they give, yes, no, they dont go in to nonsensical stories that has nothing to do with anything....
@kongvinter33Not going to lie, we don't really need your commentary on whether you think the book sounds "atrocious". It just comes across as petty and childish that you constantly insult her books throughout the video for seemingly no valid reason. Does her writing in genres you look down on have any relevance to her being a murdering psychopath??
Sorry, I get you probably dogged on her books in some attempt to be entertaining for the viewer, but it just irked me lol.
Ik shes fake crying but can someone please explain how shes able to get her nose to turn red like that?
@HackeRx831Thank you for this! I needed something entertaining and reasonable today!
@Leatherargento"It's only $40,000.00"?? That's not an only, Nancy.
@Leatherargento1:21:56 holy bruh that's a student??? she looks 40
@flibbertigibbet-at-armslowk expected a "the wrong dog" one
@flibbertigibbet-at-arms>the wrong brother
oh god oh no
911 operator is such an OG
@mk-ki4lsA 911 dispatcher who is kind, empathetic and compassionate?!
I guess she didn't get the memo about the updated standards from the American Emergency Dispatcher's Tonal Association concerning how to talk down to anyone who has the audacity to call 911 for help.
45:00 I think you mean shooty thingy!
@sugarfrosted2005she treated her questioning like its was a Q&A for her book
@MaharQaisar-l1x6:16 is when the 911 call ends if they make anyone else uncomfortable
@brainlesswormBest true crime channel out there. Thanks for another excellent documentary Matt!
@ravelineffmI can't imagine that she's a particularly gifted writer when her titles have ZERO creativity to them.
@TortoiseJamesThis is really good! I've seen almost every Brophy case analysis and this one still feels fresh. Great job!
@TortoiseJamesLovely to hear a 911 operator with some compassion for the caller. I hope she didn't end up getting burnt out.
@zappababe8577I suppose recorded evidence will have to have the EXIF data associated with it, to guard against AI and deepfakes.
@zappababe8577Oh it was her…… its normally the spouse, no one else had any reason to gun Dan down, he wasn’t robbed….. she was the only one that had anything to gain by Dans death, she lied about where she was until she was caught in cctv driving by where he was shot at the time he was killed, shes lost only one gun piece which happens to be the bit she used, 2 days after she was already trying to get life insurance, if my husband was murdered i would be inconsolable and money would be the last thing on my mind
@joannegregory3024That AI at the end scared the shit out of me. Uncanny stuff like that gets to me unlike anything else.
@MalumultimusOn TV I hate to hear a lawyer say “Objection: circumstantial!” Most murders don’t kill people in the town square at high noon. Circumstancial evidence is still evidence. Ditto: “Objection: argumentative!” All relevant evidence is an argument for SOMETHING.”
